These Terms of Service ("Terms") constitute a legally binding agreement between you ("User" or "you") and SocialWeb Strategy (trading as Immobilix), a company registered in Ireland ("we", "us", or "our").

By accessing or using the Immobilix platform, website, or any related services (collectively, the "Service"), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Service.
2. The Service
Immobilix provides an AI-powered virtual staging platform that enables real estate professionals, interior designers, and other users to generate photorealistic virtual staging renders of residential and commercial properties using curated furniture and decor products from leading retail partners.
Access to the Service is provided on a subscription basis. Features and functionality may vary depending on your chosen subscription plan. We reserve the right to modify, enhance, or discontinue features of the Service at any time. Where changes are material and may adversely affect your use of the Service, we will provide at least 30 days' written notice by email.
We aim to maintain a minimum uptime of 99.5% on a monthly basis but do not guarantee uninterrupted access to the Service. Planned maintenance will be communicated in advance where reasonably practicable.
3. Account Registration
To access the full features of Immobilix, you must register for an account. By registering, you agree to the following:
- You must be at least 18 years of age to create an account and use the Service.
- You must provide accurate, current, and complete information during registration and keep your account details up to date.
- You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
- You must not create more than one account per individual or legal entity without our prior written consent.
- You must notify us immediately at legal@Immobilix.com if you become aware of any unauthorised use of your account.
We reserve the right to refuse registration or suspend accounts at our discretion, particularly where we have reason to believe that the information provided is inaccurate or that the account is being used in breach of these Terms.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service for any illegal, fraudulent, or unauthorised purpose, or in a manner that violates any applicable Irish, EU, or international law or regulation.
- Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Immobilix AI models, algorithms, or proprietary systems.
- Upload, submit, or process content — including room photographs — that you do not own or for which you do not have the necessary rights, licences, or consents.
- Resell, sublicence, or otherwise grant third parties access to the Service without a separate written reseller or white-label agreement with SocialWeb Strategy.
- Use scraping tools, bots, or other automated means to access the Service beyond the limits expressly permitted by our API documentation.
- Transmit any malicious code, viruses, or other harmful software through the Service.
- Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
Breach of these acceptable use provisions may result in immediate suspension or termination of your account without refund.
5. Intellectual Property
All rights, title, and interest in and to the Immobilix platform, including but not limited to the website, application, AI staging models, algorithms, user interface, software, brand identity, trademarks, and all related intellectual property, are and shall remain the exclusive property of SocialWeb Strategy or its licensors.
Nothing in these Terms transfers any ownership of our intellectual property to you.
Your Content
You retain full ownership of the room photographs and other content you upload to the Service ("Your Content"). By uploading Your Content, you grant SocialWeb Strategy a limited, non-exclusive, royalty-free licence to process, store, and use Your Content solely for the purpose of providing the Service to you. We will not use Your Content for any other purpose, including training AI models on identifiable property images, without your explicit consent.
Exported Renders
Virtually staged renders generated from Your Content and exported from the platform are owned by you, subject to these Terms and any applicable third-party retailer product licence conditions. You may use exported renders for marketing, listing, and commercial real estate purposes without restriction.
6. Subscription & Billing
Immobilix is offered on a subscription basis. The following billing terms apply:
- Auto-renewal: Subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled before the renewal date.
- Billing cycles: You may choose to be billed monthly or annually. Annual plans are offered at a discounted rate.
- No partial-month refunds: We do not issue refunds for unused portions of a monthly billing period upon cancellation.
- Annual plan refunds: In accordance with the EU Consumer Rights Directive, annual plans are eligible for a full refund if cancelled within 14 days of the initial purchase date, provided the Service has not been materially used.
- Price changes: We reserve the right to adjust subscription prices. Any price changes will be communicated by email at least 30 days before they take effect. Continued use of the Service after the notice period constitutes acceptance of the new pricing.
All payments are processed securely via Stripe. By providing your payment details, you authorise SocialWeb Strategy to charge your payment method on a recurring basis in accordance with your chosen subscription plan.
7. Free Trial
SocialWeb Strategy may, at its sole discretion, offer free trial periods of the Service to prospective users. The following conditions apply to free trials:
- Free trials are limited to one trial per individual or legal entity. Attempts to circumvent this limit by creating multiple accounts are a breach of these Terms.
- We reserve the right to terminate, modify, or discontinue free trial offers at any time without notice.
- At the conclusion of the trial period, your account will be converted to a paid subscription unless you cancel before the trial ends. You will be notified in advance of the trial expiry date.
- Access to certain features may be restricted during the trial period.
8. Retailer Product Links
Immobilix integrates with a curated catalogue of furniture and home decor retailers, enabling you to link staged products directly to purchasing options. The following disclaimers apply:
- Retailer product links are provided for convenience only. SocialWeb Strategy does not guarantee the availability, pricing, delivery timescales, or quality of any products sold by linked retailers.
- We are not a party to any transaction between you and a retailer. Any purchase made through a linked retailer is governed solely by that retailer's terms and conditions.
- SocialWeb Strategy is not responsible for any loss, damage, or dissatisfaction arising from purchases made through retailer links displayed in the platform.
- We may receive referral fees from certain retail partners. This does not affect the editorial independence of our retailer catalogue.
9. Limitation of Liability
To the maximum extent permitted by applicable Irish and EU law:
- SocialWeb Strategy's total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Service shall not exceed the total fees paid by you to SocialWeb Strategy in the twelve (12) months immediately preceding the event giving rise to the claim.
- SocialWeb Strategy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, however caused and regardless of the theory of liability.
- Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under Irish law.
If you are a consumer under Irish or EU consumer protection law, these limitations do not affect your statutory rights.
10. Termination
Either party may terminate these Terms and close the associated account by providing 30 days' written notice to the other party.
SocialWeb Strategy may suspend or terminate your account immediately and without notice if:
- You breach any provision of the Acceptable Use section of these Terms.
- We are required to do so by law or a regulatory authority.
- Continued provision of the Service becomes technically or commercially impractical.
Upon termination of your account for any reason, your right to access the Service ceases immediately. Your data will be retained and subsequently deleted in accordance with our Privacy Policy and applicable data retention obligations.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of Ireland, without regard to its conflict of law principles.
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall be subject to the exclusive jurisdiction of the courts of Ireland.
If you are a consumer resident in another EU member state, you may also have the right to bring proceedings in the courts of your country of residence, in accordance with applicable EU consumer protection law. The European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
